Refund and Cancellation Policy
Effective Date: August 28, 2026
Clear Path Pools & Spas LLC is committed to fair, transparent billing and dependable service. This policy explains how customers may cancel services, request refunds, reschedule appointments, and report service concerns.
1. Weekly Pool Service
Unless your written service agreement expressly states otherwise, recurring weekly pool service is provided on a month-to-month basis.
You may cancel recurring service at any time without a cancellation fee by contacting us before your next scheduled service visit. Cancellation stops future service visits and future recurring charges.
If you prepaid for service, we will refund the amount paid for any service visits that have not been completed, less any properly disclosed amounts owed for services, chemicals, materials, or approved work already provided.
Cancellation does not eliminate charges for services completed before the cancellation became effective.
2. How to Cancel
You may cancel or request a pause by contacting Clear Path Pools & Spas through any of the following:
- Phone: (844) 572-4909
- Website: ClearPathPools.com
-
Email: info@clearpathpools.com
Your cancellation becomes effective when we receive it. We will provide confirmation by email or text, normally within one business day.
Customers are not required to cancel through the same method they used to enroll. If you do not receive confirmation, please contact us so we can verify the request.
3. Automatic and Recurring Payments
Before beginning recurring billing, Clear Path will disclose:
- The amount and frequency of the charge
- Whether the amount may vary
- Any promotional period and the regular price afterward
- How to cancel future services and payments
By enrolling in automatic payments, you authorize Clear Path to charge the approved payment method according to your service agreement.
Canceling service stops future recurring charges after all completed services and approved purchases have been billed. It does not retroactively reverse valid charges for services or materials already provided.
If we make a material change to your recurring price, we will provide advance notice and any consent required by applicable law.
4. Repairs, Green Pool Recovery and One-Time Services
One-time work may be canceled without charge before labor begins and before Clear Path purchases or specially orders materials for the project.
If you cancel after work begins, you are responsible only for:
- Labor already performed
- Chemicals and materials already used
- Nonreturnable or specially ordered parts
- Reasonable, previously disclosed restocking or return charges
- Other amounts specifically approved in the estimate or work order
Any remaining prepaid balance will be refunded.
Clear Path will not perform additional work that materially exceeds an approved estimate without obtaining customer authorization, except when immediate action is reasonably necessary to protect people or property.
5. Deposits
Unless an estimate or agreement clearly states otherwise:
- A deposit is refundable before work begins, minus documented nonreturnable parts or costs already incurred with the customer’s approval.
- After work begins, Clear Path may retain only the portion reasonably attributable to completed work and committed costs.
- Any unused balance will be refunded.
Any nonrefundable deposit or special-order item must be clearly identified in writing before payment.
6. Rescheduling and Missed Appointments
Customers should provide at least one business day’s notice when rescheduling a one-time appointment.
If access to the property, pool, equipment, or approved utilities is unavailable when we arrive, we may charge a reasonable trip fee—but only if the fee was disclosed before the appointment. We may waive the fee for emergencies or circumstances beyond the customer’s reasonable control.
Weekly service may be rescheduled because of unsafe weather, holidays, equipment failure, road conditions, or other circumstances outside our control. A delayed visit is not considered a missed service if it is completed within a reasonable period.
If a prepaid visit cannot be completed or reasonably rescheduled, the customer will receive a credit or refund for that visit.
7. Service Concerns and Our Promise to Make It Right
If you believe a service was incomplete, incorrectly billed, or not performed as promised, contact us as soon as reasonably possible.
We will review the service record, technician notes, photographs, chemical readings, invoices, and other available information. When a service problem is confirmed, Clear Path may, as appropriate:
- Return and correct the service at no additional charge
- Apply a fair account credit
- Refund the affected service charge
- Provide another reasonable resolution agreed upon with the customer
Nothing in this policy limits any nonwaivable warranty or consumer right provided by law.
8. Refund Eligibility
Refunds or credits will generally be provided for:
- Services paid for but not performed
- Duplicate or unauthorized charges
- Verified billing errors
- Unused prepaid service after cancellation
- Materials returned and accepted by the supplier, less a previously disclosed restocking charge
- Service that materially failed to match the approved description and was not corrected within a reasonable time
Refunds are generally not provided for:
- Services properly completed
- Chemicals or materials already used
- Special-order parts that cannot reasonably be returned, if disclosed before purchase
- Problems caused by preexisting conditions, customer actions, unauthorized third parties, severe weather, water loss, equipment failure, or conditions outside Clear Path’s reasonable control—unless Clear Path contributed to the problem
We will not deny a refund that is required by applicable law.
9. Promotional Offers
Promotional terms, including any “Start Today” offer, introductory price, discount, or service credit, will be disclosed before enrollment.
If a promotion converts to recurring paid service, the customer will be told:
- The promotional charge
- The regular recurring charge
- When regular billing begins
- How to cancel before the next charge
Canceling service does not create a retroactive charge or penalty unless that condition was clearly disclosed and accepted before purchase.
10. Refund Processing
Approved refunds will be issued to the original payment method whenever reasonably possible.
Clear Path will generally initiate the refund within five business days after approval. Banks and payment processors may require an additional five to ten business days to post the refund.
If the original payment method cannot accept the refund, we will arrange another reasonable method.
11. Three-Business-Day Right to Cancel
Some transactions made at a customer’s home, workplace, or certain temporary locations may be covered by the Federal Trade Commission’s Cooling-Off Rule.
When that rule or another applicable law provides a right to cancel, Clear Path will provide the required cancellation notice and honor a timely cancellation. This policy does not reduce or replace any cancellation right provided by federal, state, or local law.
Emergency repairs and customer-requested maintenance visits may be treated differently under applicable law.
12. Resolving Billing Disputes
We ask customers to contact us first so we have an opportunity to investigate and resolve the matter promptly. Contacting Clear Path does not waive a customer’s right to contact a payment provider, the Better Business Bureau, the Mississippi Attorney General, or another government agency.
We will respond to customer complaints honestly, professionally, and in good faith.
13. Changes to This Policy
We may update this policy prospectively. Material changes will not retroactively reduce a customer’s refund or cancellation rights for an existing purchase.
The effective date shown above identifies the current version.
