All services, pricing, availability, and service boundaries are subject to change or modification at our discretion. We reserve the right to refuse service to any property or individual where safety hazards, aggressive animals, or unsafe conditions exist.

2. Service Area & Governing Law

Our services and website are intended solely for residents and properties located within the State of Mississippi. These Terms & Conditions shall be governed by, construed, and enforced in accordance with the laws of the State of Mississippi, without regard to its conflict of law principles. Any legal action or proceeding arising out of these terms shall be brought exclusively in the state courts located in Mississippi.

3. Customer Responsibilities & Property Access

To ensure safe and efficient service, customers agree to:

  • Accurate Information: Provide accurate contact, property, pool system, and payment details.

  • Property Access: Ensure clear, safe, and unobstructed access to the work area, gate codes, equipment pads, and pool areas on scheduled service days.

  • Pet Control: Secure all pets away from the service area prior to the arrival of our service technicians.

  • Utilities: Provide working water and electrical hookups necessary to perform requested services.

Clear Path Pools & Spas is not responsible for delayed or incomplete services resulting from a customer’s failure to provide safe access or necessary utilities.

4. General Communications

By providing your contact details (email address, phone number, physical address), you authorize Clear Path Pools & Spas to contact you regarding inquiries, estimates, scheduling updates, service completion reports, billing notices, and general customer care communications.

5. SMS & Mobile Communications Terms

If you explicitly opt-in to receive text messages (SMS) from Clear Path Pools & Spas, the following terms apply:

  • Message Types: You may receive transactional text messages regarding appointment confirmations, service reminders, technician arrival updates, billing notifications, and customer support. If separately authorized, you may receive occasional promotional text messages.

  • Opt-Out: You can cancel the SMS service at any time by replying STOP to any text message you receive from us. After sending STOP, you will receive a single confirmation message verifying your opt-out status.

  • Rates & Frequency: Message frequency varies based on your service schedule and activity. Message and data rates may apply according to your mobile carrier plan.

  • Disclaimer: Wireless carriers are not liable for delayed, misdirected, or undelivered messages. Consent to receive marketing text messages is not a condition of purchasing any goods or services.

6. Payments, Billing, and Cancellations

  • Payment Due Date: Invoices are due upon receipt or according to the specific terms set forth in your service agreement or invoice. Late payments may incur administrative or late fees.

  • Cancellations: Recurring service cancellations or one-time appointment changes require notice prior to the scheduled service date. Specific cancellation windows and potential fee schedules will be provided at the time of scheduling.

7. Limitation of Liability & Warranties

  • Service Disclaimer: Services are performed using standard industry techniques and equipment. We are not responsible for pre-existing pool or spa conditions, structural defects, aged or brittle plumbing/equipment failures, or chemical imbalances caused by third-party interference, heavy rainfall, or acts of nature between scheduled service visits.

  • Website “As-Is”: Our website and its content are provided on an “as-is” and “as-available” basis without warranties of any kind, either express or implied.

  • Liability Cap: To the maximum extent permitted by Mississippi law, Clear Path Pools & Spas’ total aggregate liability arising out of or related to our services or website shall not exceed the total amount paid by the customer for the specific service giving rise to the claim.
